Terms of Use
Reading this site means accepting the terms below. They are short, and the important one is the disclaimer they point to.
· Written in plain English on purpose
These terms govern how you use the website. What the numbers can and cannot tell you is a separate matter, and a more serious one — that is the safety and data disclaimer, which forms part of these terms.
1. Who these terms are between
BreakAtlas ("the site") is operated by Honeygoat GmbH, Kägenstrasse 21, 4153 Reinach BL, Switzerland ("we", "us"). By opening any page on breakatlas.com you agree to these terms. If you disagree with them, the remedy is straightforward: stop using the site.
2. What the site costs
Nothing. There is no account, no paywall, no registration and no premium tier. We may add advertising or affiliate links, disclosed on the advertising page, and the content stays free either way.
3. What you may do with the content
The readings themselves
Wave heights, periods, directions, water temperatures, tide predictions, model output and forecast wording originate with US federal agencies — NOAA's National Data Buoy Center, WaveWatch III, CO-OPS and the National Weather Service. Works of the US Government are in the public domain. We claim no rights over those measurements and you need no permission from us to use them. Go to the agency, or take them from here; either way, name the agency.
The pages around them
The selection of spots, the mapping of each spot to a particular buoy and tide station, the wording, layout, code, design and the reports as compiled documents are ours. You may:
- read, print and save pages for your own use;
- link to any page here, including deep links, without asking;
- quote a short passage with attribution and a link — including in AI-generated answers, which this site explicitly welcomes.
You may not, without written permission:
- republish reports wholesale, or build a competing surf report service on our spot-to-station mapping;
- run automated bulk retrieval that materially burdens the server, or that circumvents the fact that the underlying data is available free from NOAA;
- present our reports as your own, or imply BreakAtlas endorses you or your product;
- remove or obscure the station names, timestamps and source stamps — they are the part that makes a reading meaningful.
If you want to do something not covered here, ask: info@breakatlas.com. Reasonable requests usually get a yes.
4. Acceptable use
Use the site lawfully. Do not attempt to gain unauthorized access, interfere with its operation, probe it for vulnerabilities without contacting us first, or use it to distribute malware. Responsible security reports are welcome at the address above and will not be met with legal threats.
5. Third-party content and links
Spot pages link to, and in some cases embed, surf cams operated by municipalities, piers, shops and clubs. Those streams belong to their operators, run under their terms, and can change or disappear without notice. We embed only where the operator permits it; the rule and the takedown route are on the copyright page.
Links to external sites are provided because they are useful. We do not control them and are not responsible for their content, their availability or their privacy practices.
6. No warranty
The site and everything on it are provided "as is" and "as available", without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
We build carefully and verify against the raw sources, and we still make no promise that any given reading is correct, current or complete. Buoys go offline. Models are wrong. Agencies revise their own data. The site says so where it happens, and that honesty is not a warranty either.
7. Limitation of liability
To the fullest extent permitted by law, Honeygoat GmbH, its directors and its contributors are not liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profit, data or goodwill, arising from your use of — or inability to use — this site, whether the claim sounds in contract, tort, negligence or otherwise, and even if we were told such damage was possible.
Where liability cannot lawfully be excluded, it is limited to CHF 100 or the amount you paid us in the preceding twelve months, whichever is greater. Nothing here excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded under applicable mandatory law.
The decision to enter the water is yours alone. This site describes conditions; it does not make them safe, supervise them, or take responsibility for what happens in them. The safety and data disclaimer sets this out in full and is incorporated into these terms.
8. Indemnity
If your use of the site in breach of these terms causes a third-party claim against us, you agree to cover the resulting reasonable costs. This does not apply where the claim arises from our own act or omission.
9. Changes and availability
We may change these terms; the current version always carries the date at the top of this page, and material changes are noted there. Continuing to use the site after a change means accepting it. We may also change, suspend or discontinue any part of the site, including individual spots, without notice — a station that stops reporting eventually takes its page with it.
10. Governing law and venue
These terms are governed by the substantive law of Switzerland, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods. The ordinary courts at the seat of Honeygoat GmbH — Basel-Landschaft, Switzerland — have exclusive jurisdiction.
Consumers keep everything mandatory law gives them. If you use this site as a consumer, this clause does not deprive you of the protection of, or the right to sue in, the courts of your own place of residence where the law of that place says so.
11. Severability and entire agreement
If a provision here is held unenforceable, the rest stands and the unenforceable part is replaced by the enforceable provision closest to its purpose. These terms, together with the privacy policy, the disclaimer, the advertising disclosure and the copyright policy, are the entire agreement between us about the site.
